Agreement to Terms

By accessing or using the services provided by Danish Solutions ("we," "our," or "us"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

Our Services

Danish Solutions provides professional software development services, including but not limited to:

  • Full-stack web application development
  • Mobile application development (Flutter, React Native)
  • Backend API development (Django, Node.js)
  • Database design and optimization (PostgreSQL, MongoDB)
  • Cloud deployment and DevOps services
  • Technical consulting and architecture design

Service Terms and Conditions

Project Scope and Deliverables

  • All projects require a signed contract or statement of work before commencement
  • Project scope, timeline, and deliverables will be clearly defined in writing
  • Changes to scope may require additional fees and timeline adjustments
  • We reserve the right to refuse or terminate projects at our discretion

Payment Terms

  • Payment terms and schedules will be specified in the project contract
  • Typical payment structure: 50% upfront, 50% upon completion (may vary by project)
  • Late payments may incur interest charges and project suspension
  • All prices are in USD unless otherwise specified
  • Refund policies are project-specific and will be outlined in contracts

Timeline and Delivery

  • Project timelines are estimates and subject to change based on scope changes or unforeseen circumstances
  • Client delays in providing necessary materials or feedback may extend timelines
  • We are not liable for delays caused by third-party services or force majeure events

Intellectual Property Rights

Client Ownership

Upon full payment, clients receive ownership of custom code and deliverables created specifically for their project, subject to the following:

  • Ownership transfers only after complete payment is received
  • Third-party libraries, frameworks, and open-source components remain under their respective licenses
  • We retain rights to reusable components, templates, and methodologies developed before or independently of the project

Our Rights

  • We retain the right to showcase completed projects in our portfolio unless agreed otherwise
  • We may use anonymized project data for case studies and marketing
  • Our logos, branding, and proprietary methodologies remain our exclusive property

Client Responsibilities

Clients agree to:

  • Provide accurate and complete information necessary for project completion
  • Respond to requests for feedback and approvals within agreed timelines
  • Provide access to necessary accounts, credentials, and resources
  • Ensure they have rights to any content, materials, or assets provided to us
  • Not use our services for illegal, harmful, or unethical purposes
  • Maintain confidentiality of any credentials or sensitive information shared

Warranties and Disclaimers

Our Warranties

  • We warrant that services will be performed in a professional and workmanlike manner
  • We provide bug fixes and support as outlined in project contracts
  • We follow industry best practices for security and code quality

Disclaimers

SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT GUARANTEE:

  • Specific results, traffic, revenue, or business outcomes
  • Complete absence of bugs or errors (though we strive for quality)
  • Compatibility with future third-party updates or changes
  • Uninterrupted or error-free operation

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • Our total liability shall not exceed the amount paid by the client for the specific project
  • We are not liable for indirect, incidental, consequential, or punitive damages
  • We are not responsible for data loss (clients should maintain backups)
  • We are not liable for damages caused by third-party services or force majeure events
  • Clients must report issues within 30 days of discovery for warranty coverage

Confidentiality

Both parties agree to maintain confidentiality of proprietary information shared during the engagement. This includes:

  • Business strategies and plans
  • Technical specifications and architecture
  • Credentials and access information
  • Financial information
  • Any information marked as confidential

Confidentiality obligations survive termination of the service agreement.

Termination

Either party may terminate services under the following conditions:

  • By Client: With written notice, subject to payment for completed work
  • By Us: For non-payment, breach of terms, or unethical requests
  • Effect of Termination: Client receives work completed to date; final invoice becomes due immediately

Dispute Resolution

In the event of disputes:

  • Parties agree to first attempt resolution through good-faith negotiation
  • If unresolved, disputes will be settled through binding arbitration
  • Arbitration will be conducted in accordance with applicable laws
  • Each party bears their own legal costs unless otherwise awarded

Changes to Terms

We reserve the right to modify these Terms of Service at any time. Changes will be effective immediately upon posting. Continued use of our services after changes constitutes acceptance of updated terms.

Governing Law

These Terms of Service are governed by and construed in accordance with the laws of India. Any disputes shall be subject to the exclusive jurisdiction of courts in New Delhi, India.
